This Cookie Policy applies to the Digital Services offered by LUXEM CARE, a commercial company identified with Tax Identification Number (NIT) 901988703 (hereinafter, “LUXEM CARE”), and forms an integral part of the Company’s Personal Data Processing Policy, which describes our practices regarding the use of cookies.

Within the Digital Services used by LUXEM CARE, various technologies are employed, including cookies (“Cookies and Similar Technologies”). Potential Users (Natural Persons or Legal Entities)

The data collection process for potential users is carried out in two ways: through our websites and through commercial agents.

Data is collected through our website when individuals interested in our services provide their contact information to reach out to us, or when individuals request scientific information from our website and provide their contact details in order to receive such information.

Data collection by our commercial agents takes place during the commercial relationship process, where contact information is exchanged.

Registered Users (Natural Persons or Legal Entities)

  • Individual users: Registration is carried out through a form available on the website, which must be completed when requesting a LUXEM CARE service, and may also be completed through commercial agents.

  • Corporate users: Registration is carried out through a user registration form completed on the website once the commercial process with our commercial agent has been completed.

Data of Applicants, Current and Former Employees of LUXEM CARE

Personal data is collected during the recruitment and selection process, in which résumés and relevant information are requested, and continues until the hiring of suitable candidates for the position, as well as during and after the employment relationship, as applicable.

This Cookie Policy shall be interpreted in a harmonious, complementary, and non-exclusive manner with the Personal Data Processing Policy of LUXEM CARE. In the event of any differences in application, the provisions contained in the Personal Data Processing Policy shall prevail, without prejudice to the specific nature of this policy with respect to the use of cookies and similar technologies.

This Personal Data Protection and Processing Policy is intended to guarantee the protection of the Habeas Data right held by every natural person (hereinafter, the “Data Subject”), as well as to regulate the use of personal data by LUXEM CARE S.A.S., a commercial company identified with Tax Identification Number (NIT) 901988703 (hereinafter, “LUXEM CARE”).

This Policy is issued in accordance with the provisions of Law 1581 of 2012, considering LUXEM CARE’s capacity as Data Controller and/or Data Processor, as defined therein. Personal data shall be processed at all times in compliance with the constitutional principles of lawfulness, purpose limitation, freedom, accuracy, transparency, restricted access and circulation, security, and confidentiality, ensuring full respect for the fundamental rights of Data Subjects.

In the case of personal data provided by minors, such data shall be processed only with the prior, express authorization of their parents, legal representatives, or guardians, and in strict compliance with applicable legal provisions aimed at protecting the best interests of the child.

All information collected by LUXEM CARE through its various communication channels—whether digital or physical—and forming part of its databases, including information related to users, employees, contractors, or other Data Subjects, shall be governed by this Policy.

If you are included in our databases, it is because you currently maintain or have previously maintained a relationship with LUXEM CARE as a user, patient, partner, employee, or contractor, or because you have voluntarily provided your personal data during events, institutional activities, virtual interactions, or directly at our facilities.

1. LEGAL FRAMEWORK AND SCOPE OF APPLICATION

This Personal Data Processing Policy has been prepared in accordance with the Colombian Constitution, Law 1581 of 2012, Regulatory Decree 1377 of 2013, and all regulations that amend, supplement, or regulate them. It shall apply to all activities involving the collection, storage, use, circulation, transmission, transfer, and deletion of personal data carried out by LUXEM CARE.

Any regulatory gaps shall be interpreted in accordance with Colombian law, Articles 15 and 20 of the Political Constitution of the Republic of Colombia, and applicable principles of International Law. LUXEM CARE guarantees the rights to privacy, intimacy, and good name in the processing of personal data, and all actions shall be governed by the principles of legality, purpose limitation, freedom, accuracy, transparency, restricted access and circulation, security, and confidentiality.

Except for the legal exceptions provided by law, the processing of personal data requires the prior, express, and informed authorization of the Data Subject, which shall be obtained by any means capable of subsequent verification.

Authorization shall not be required in the following cases:

  • Information required by a public or administrative authority in the exercise of its legal functions or by court order;

  • Public data;

  • Medical or health emergencies;

  • Processing authorized by law for historical, statistical, or scientific purposes;

  • Data related to the Civil Registry of Persons.

2. DEFINITIONS

For purposes of this Policy and in accordance with Law 1581 of 2012 and its regulations:

  • Personal Data: Any information that identifies or may identify a natural person.

  • Sensitive Data: Data affecting the intimacy of the Data Subject or whose improper use may lead to discrimination, including health or biometric data.

  • Data Subject: The natural person whose personal data is processed.

  • Authorization: Prior, express, and informed consent of the Data Subject.

  • Processing: Any operation performed on personal data, such as collection, storage, use, circulation, or deletion.

  • Data Controller: The natural or legal person who decides on the database and its processing.

  • Data Processor: The person who processes data on behalf of the Data Controller.

All other definitions shall be interpreted in accordance with applicable Colombian law.

3. PURPOSES OF DATA COLLECTION AND PROCESSING

LUXEM CARE processes personal data exclusively for purposes related to its corporate purpose, including but not limited to the provision of integral dental tourism services, coordination of clinical procedures, organization of complementary tourism services (accommodation, transportation, gastronomy, recreation, and culture), administrative and contractual management, marketing, loyalty programs, and communications.

Where necessary, data may be transmitted or transferred to healthcare providers (IPS), licensed dental professionals, strategic partners, or other third parties acting as Data Processors or Controllers, always under contractual obligations to comply with applicable data protection regulations.

Processing of Sensitive Data

When sensitive data is required, LUXEM CARE shall:
a) Obtain explicit authorization from the Data Subject;
b) Ensure proper custody of the data;
c) Guarantee confidentiality and restricted access;
d) Use such data exclusively for the purposes stated in this Policy.

4. RIGHTS OF DATA SUBJECTS

Data Subjects, either directly or through their legal representatives, may exercise the following rights:

  • To access, update, rectify, and delete personal data;

  • To request proof of authorization;

  • To be informed about the use of their data;

  • To file complaints before the Superintendence of Industry and Commerce (SIC);

  • To revoke authorization when legal or constitutional principles are violated;

  • To free access to personal data at least once per calendar month.

The rights of minors shall be exercised by their legal representatives.

5. DATA RETENTION

Personal data shall be processed only for the time necessary to fulfill the purposes for which it was collected, or as required by legal or contractual obligations. Once such purposes are fulfilled, data shall be deleted unless retention is legally required.

6. SECURITY MEASURES

LUXEM CARE adopts technical, human, and administrative measures to protect personal data against unauthorized access, loss, alteration, or misuse, including restricted access, secure authentication systems, backups, staff training, and secure storage.

7. VALIDITY

This Personal Data Processing Policy enters into force on September 5, 2025, and remains in effect indefinitely, without prejudice to the Data Subject’s right to revoke authorization as permitted by law.

LUXEM CARE reserves the right to amend this Policy when required by legal changes or operational needs. Any amendments shall be duly communicated to Data Subjects.
